Terms of Service

By downloading, installing, or using Lumo ("the app"), you agree to these Terms of Service. If you do not agree, do not use the app.

The service

Lumo is a mobile application that enhances real estate and property listing photographs using artificial intelligence. The app processes photos you take with your device's camera and returns enhanced versions suitable for use in property listings, marketing materials, and related purposes.

Acceptable use

Lumo is intended for enhancing photographs of real properties for listing, marketing, rental, and related real estate purposes. You agree to use Lumo only for lawful purposes and in accordance with these terms.

You may not use Lumo to generate images that materially misrepresent a property's dimensions, structural features, condition, or physical characteristics. Enhanced photos should reflect the property as it actually exists. Lighting, color balance, and aesthetic improvements are acceptable. Adding structural elements, hiding damage, or altering room dimensions is not.

You may not use Lumo for any purpose unrelated to real estate or property photography at scale, including but not limited to: bulk image processing for non-property content, reselling enhanced images as a service, or building competing products using Lumo's output.

You may not use automated tools, scripts, bots, or any non-human means to access or interact with the app.

Fair use

Pro subscriptions include unlimited photo enhancements for legitimate real estate, rental, and property listing purposes. "Unlimited" means there is no fixed cap on the number of enhancements a Pro subscriber may perform, subject to the rate limits described below. It does not mean the service can be used for bulk, automated, or non-real-estate purposes.

To ensure fair access for all users and prevent abuse, Lumo applies automated rate limits on photo enhancements and other AI-powered features across all account tiers, including Pro. These limits are designed to reflect normal real estate workflows and will not affect typical usage. Users who consistently exceed these thresholds may be temporarily rate-limited or contacted for clarification. We reserve the right to suspend access to accounts with usage patterns that degrade the service for others.

AI-generated listing descriptions are subject to per-listing and daily generation limits across all tiers. These limits are designed to support legitimate listing workflows and are not intended to restrict normal use.

AI disclosure and compliance

Photos enhanced by Lumo are processed using artificial intelligence. You are responsible for understanding and complying with all applicable disclosure requirements in your jurisdiction, including MLS rules, NAR guidelines, state real estate commission regulations, and local disclosure laws.

For photos that include virtual staging (AI-generated furniture or decor added to empty rooms), Lumo provides an optional "Virtually Staged" compliance label. We strongly recommend enabling this label for all virtually staged photos used in property listings. Failure to disclose virtual staging where required by law or regulation is your responsibility.

Lumo does not provide legal advice regarding disclosure requirements. Consult your broker or legal counsel if you are unsure about the regulations in your market.

Subscriptions and billing

Lumo's in-app purchases are governed by Apple's Standard End User License Agreement (EULA), which applies to all users of the app.

Lumo offers a free tier and a paid Pro subscription. The free tier includes access to core features with a limit of one active listing and a lifetime cap on photo enhancements, as described below. The Pro subscription provides access to all features, including unlimited listings, unlimited enhancements subject to fair use limits, agent branding on exported photos, and the ability to remove the Lumo watermark.

Billing: Pro subscriptions are billed through the Apple App Store on a monthly or yearly basis. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.

Cancellation: You may cancel your subscription at any time through the App Store. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date. No partial refunds are provided for unused portions of a billing period.

Downgrade behavior: When a Pro subscription expires or is cancelled, your account reverts to the free tier. Pro-only features — including agent branding on exports and the ability to disable the Lumo watermark — are automatically disabled. The Lumo watermark will automatically re-enable on all future exports. Your free tier enhancement balance (the remaining portion of your 50-enhancement lifetime allowance) is preserved and unaffected by your subscription history.

Price changes: We may update subscription pricing for new subscribers at any time. Existing subscribers will continue at their current rate for the duration of their active subscription, as long as the subscription remains active and is not cancelled and re-subscribed.

Free tier limits: The free tier is limited to one listing and a lifetime total of 50 photo enhancements. The listing limit is enforced at the point of creation. The enhancement limit is tracked on-device, persists across app reinstalls, and is not resettable. All photos exported on the free tier include a Lumo watermark. Upgrading to Pro suspends the lifetime enhancement counter for the duration of your subscription; your remaining free enhancements are preserved if you later downgrade.

Your content

You retain full ownership of your original input photos. We do not claim any rights to your original photos or any content you upload to the app. The copyright status of AI-enhanced output images is subject to ongoing legal development and may vary by jurisdiction — see "Ownership of AI-enhanced output" below for details.

By using the app, you grant us a limited, non-exclusive license to transmit your photos to our AI processing provider solely for the purpose of generating enhanced versions. This transmission occurs only when you explicitly initiate an enhancement.

Ownership of input photos

By uploading a photo to Lumo, you represent and warrant that you own the photo or have explicit permission from the copyright holder — including any professional photographer who captured the image — to upload and process it using AI. Many professional real estate photographers retain full copyright of their work and prohibit AI processing without consent. It is your sole responsibility to verify you have the necessary rights before uploading any photo to Lumo. Lumo LLC assumes no liability for copyright infringement arising from photos uploaded by users.

Ownership of AI-enhanced output

Photos processed by Lumo are enhanced using OpenAI's image generation API. The copyright status of AI-generated images is subject to ongoing legal development and may vary by jurisdiction. Lumo does not claim ownership of your enhanced output images. However, Lumo makes no warranties regarding your ability to claim full copyright ownership of AI-enhanced images. Users assume all responsibility for how enhanced images are used, published, or distributed.

Intellectual property

Lumo, its design, code, features, and branding are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the app.

The "Lumo" name, logo, and associated branding elements are our trademarks. You may not use these marks without our written permission, except as they naturally appear on photos exported from the app (such as the free tier watermark or agent branding that includes the app name).

Disclaimers

Service availability: Lumo depends on third-party AI services to process photos. We strive for continuous availability but cannot guarantee uninterrupted service. The app may experience downtime due to maintenance, AI provider outages, network issues, or other factors beyond our control. We are not liable for delays or inability to process photos.

Output quality: AI-enhanced photos are generated automatically and results may vary significantly depending on input photo quality, lighting conditions, room type, furnishing state, camera angle, and other factors outside our control. We make no guarantee that any enhanced photo will meet your aesthetic expectations, comply with MLS or platform requirements, or be suitable for any specific listing or marketing purpose. You are solely responsible for reviewing all enhanced photos before use and for determining their suitability for your intended purpose. Purchasing a subscription does not entitle you to a refund on the basis of output quality.

No warranties: The app is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Compliance with real estate advertising laws

Lumo is a photo enhancement tool that uses AI to improve the quality of real estate listing photos. Lumo is designed to enhance lighting, color balance, and overall image quality — not to alter structural elements, remove or add physical features, or misrepresent the condition or appearance of a property. Users acknowledge that AI-generated enhancements may nonetheless alter the visual appearance of a property beyond standard lighting and color correction.

It is the sole responsibility of the user — including any licensed real estate agent, broker, or their representatives — to review all enhanced images prior to use in any MLS listing, advertisement, or promotional material, and to ensure compliance with all applicable laws and regulations, including but not limited to California AB 723, local MLS rules, NAR Code of Ethics Articles 2 and 12, and any brokerage policies governing digitally altered images.

Lumo LLC assumes no liability for MLS violations, misrepresentation claims, disciplinary actions, or legal proceedings arising from the use of images processed through the Lumo platform.

Indemnification

You agree to defend, indemnify, and hold harmless Lumo LLC and its owners, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the app; (b) any photos you upload, including any copyright infringement claims from photographers or other rights holders; (c) your use of enhanced images in MLS listings, advertisements, or any other context; (d) your violation of these terms; or (e) your violation of any applicable law or third-party right.

Eligibility

You must be at least 18 years of age to use Lumo. By using the app, you represent that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are using the app on behalf of a brokerage or other business entity, you represent that you are authorized to bind that entity to these terms.

Dispute resolution

Any dispute, claim, or controversy arising out of or relating to these terms or your use of Lumo shall first be submitted to binding arbitration administered under the rules of the American Arbitration Association (AAA) before any litigation may be initiated, except that either party may bring a claim in small claims court if it qualifies. You waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration. Arbitration shall take place in New Jersey. This clause does not prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Lumo, including but not limited to: lost sales or commissions, property listing delays, MLS compliance issues, buyer complaints about photo accuracy, or any other damages related to your use of enhanced photos in real estate transactions.

Our total liability for any claim related to the app shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

Account termination

We reserve the right to suspend or terminate access to the app for accounts that violate these terms, including but not limited to: automated or scripted usage, reselling access to the service, processing non-real-estate content at scale, or any activity that degrades the service for other users.

If your account is terminated for a violation of these terms, you are not entitled to a refund of any subscription fees.

Changes to these terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of Lumo after changes constitutes acceptance of the updated terms. For material changes that affect your rights, we will make reasonable efforts to notify you through the app or via email if you have provided one.

Governing law

These terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
